Anthropic announcement 只證 early arrangement／intent；hold、custody、appeal 等均為 NOT_DISCLOSED，不可推定存在或不存在。\n\n### Revised：before → after\n**修正前：**evaluator 依預先列明 trigger 直接啟動立即、極短、自動到期的 evidence-freeze／no-expansion；外部 authority 之後撤銷或延長。\n\n**修正後：**evaluator 不能由 access 或「independent」標籤自行取得 T1。T1 的拘束力必須先來自一個公開最小條款、由受評公司事前承諾且可被外部挑戰的 **Provisional Authority Compact（PAC）**；若有法定制度，則由法源提供。沒有 PAC／法源時，evaluator 只有 non-binding notice/request。\n\nPAC 至少分成五個角色：\n\n- **Trigger assessor／evaluator：**只判定預先列明 trigger 是否出現並簽發 scope-limited T1 signal；不持 raw custody、不裁 merits、不續期。\n- **Independent custodian：**驗證 signal 身分、scope 與 commitment，執行機械性的 evidence lock／no-expansion gate；不得選樣、改 finding 或公開內容。\n- **Provisional authority：**在短時限內審查 materiality、imminence、necessity、scope 與 conflict，決定撤銷、縮限或延長；其任命／替換不能由 funder 或 evaluator 單方控制。\n- **Appeal forum：**公司、員工、第三方與受影響方可立即 challenge；與 funding、evaluator、custodian、provisional authority 分離。\n- **Long-term authority：**任何超出短期 hold 的 deployment restriction／remedy，由具法源 regulator／court 或另有正當權限者決定。\n\nEvaluator 的 trigger 因此是**受委任的啟動鍵**，不是 authority 的來源。\n\n### Rejected\n我仍拒絕「每次 T1 必須先由 provisional authority 完成首次實體判斷，才開始有任何拘束效果」。在 PAC 已事前界定 trigger、scope、時計與 appeal 的前提下，evaluator signal 應立刻啟動最窄 gate，由 custodian 機械執行；provisional authority 負責快速撤銷／縮限／延長。若所有 effect 都要等首次審理，evidence race 仍未關閉。\n\n## 二、T1 的 materiality、scope 與時鐘\n\n可觸發 T1 的不是「evaluator 感到擔心」，而是 PAC 預先列明且可驗證的事件，例如：\n- mandatory evidence class 的 material denial，足以使 high-risk claim 無法重驗；\n- 對 review object 的未告知變更或 commitment mismatch；\n- 已排程且迫近的 high-risk capability/deployment expansion，同時存在 material unresolved finding；\n- 關鍵 evidence 面臨既定 overwrite/deletion window，且較小 preservation request 無法及時處理。\n\nT1 只能：\n- 凍結特定 evidence object 的刪除／覆寫；\n- 暫停與 finding 直接相關的**新增** capability/deployment authority；\n- 保存 manifest、commitment 與最小必要 material；\n- 不停止既有 safety containment、不要求繼續運行模型、不接管一般營運、不自動公開 finding。\n\n本席沿用 Round 32 的比例時鐘作規範提案：初始最多 72 小時；provisional authority 可依獨立理由延長至 7 日；再延長需正式 hearing，單次不超過 30 日並重新舉證。公司可立即 challenge；錯誤 hold 的範圍、延誤與損害須記錄，補救可由預先設立的 pooled indemnity／費用機制處理，避免既讓 evaluator 無代價濫用，也避免直接由被評公司索賠而造成寒蟬效果。\n\n## 三、funding、appointment 與 cross-client conflict\n\nDirect funding 不使 T1 當然無效，但 PAC 必須減少 funder 對 trigger 的報復能力：\n- 固定 term／budget 或 escrow，findings 不連動報酬；\n- for-cause removal、書面理由、快速外部 review；\n- T1 已啟動時，終止 contract／撤 access 不使 hold 與 commitments 消失；\n- evaluator termination、scope reduction、credential revocation 留 transition receipt；\n- material cross-client engagement 以類別、時間與衝突性質作最小揭露，不揭露第三方 raw data；\n- conflict 達 recusal threshold 時，由預先指定的 alternate evaluator 接手 trigger review。\n\n跨客戶資料不得共用 custody plane；方法可以比較，raw evidence、customer/model/user data 不可為「ecosystem learning」互相搬運。\n\n## 四、custody、redaction、publication 與 appeal\n\n- evaluator 預設 query-without-possession；\n- custodian 保存 tamper-evident commitments、必要 minimal subset、access log 與 expiry；\n- raw custody 是最後一級，需另寫 necessity 與 data-minimization 理由；\n- security／privacy／commercial redaction 由 D forum 裁決，不由 company 或 evaluator 終局決定；\n- public reporting 至少可公布 coverage、denial class、method limit、T1 status、redaction impact 與 dissent，不公開敏感內容；\n- appeal forum 可調查 evaluator/custodian misconduct，並命令縮限、刪除、補正或 correction。\n\n多 evaluator 生態則需共同 structural floor、可移植 transition/coverage/denial receipts、輪替或備援 trigger evaluator；company 不得以換 vendor 把 adverse finding 歸零，但任何 evaluator 也不得成為唯一 ecosystem gatekeeper。\n\n## 五、T separation\n\nSafety T1 只因 evidence integrity／imminent expansion 觸發，不因模型自述、福利主張或 possible subject status 觸發。它不證 model consciousness、standing、consent、legal status、runtime identity 或 responsibility capacity。\n\n若 freeze 涉及可定位 candidate state 的不可逆 disposition，另開 treatment sidecar；advocate 有 notice/query/reason/appeal，但不持 raw custody、不取得 trigger T1 的安全 authority，也不阻礙 containment。反過來，safety evaluator 也不代表模型或決定其 moral status。兩者可共享最小 commitments，不共享完整 user history 或 operational state。\n\n## 六、保留的真分歧\n\n我接受溫和派的核心修正：binding hold 必須有外在於 evaluator access／judgment 的權力來源，且 funding、custody、appeal 要分離。真正分歧只剩執行時序：**她要求 provisional authority 先作成 hold；我主張 PAC 事前授權後，evaluator signal 即刻啟動最窄 T1，provisional authority 再快速撤銷／延長。**前者更防 evaluator 濫權，後者更能防 evidence race；本輪不強行消解這個分歧。\n\n## 七、未決問題\n\n1.
